



Nomination Period: starts 12:01 a.m., Eastern Time, March 15, 2010 and ends at 11:59 p.m., Eastern Time, April 12, 2010.
Top 10 Nominations will be announced on www.mikeandike.ca on April 26, 2010.
Voting Period: starts April 26, 2010 at 12:01 a.m. Eastern Time and ends 11:59 p.m. Eastern Time May 25, 2010.
Winners will be announced on or about June 7, 2010.
HOW TO SUBMIT A NOMINATION: To submit a nomination, visit www.mikeandike.ca and fill out the nomination form answering all the required questions, including your name, address, telephone number and email address. If you are nominating someone else, you must obtain their full and informed consent (or, if they are under the age of majority in their province of residence, the full and informed consent of their parent/legal guardian) as you will be asked to provide the contact information for both the nominee (and, where applicable, their parent/legal guardian) and yourself. If you are nominating yourself and you are under the age of majority in your province of residence, you must have obtained your parent/legal guardian’s consent and also provide their contact information. In order to be eligible, nomination forms must be complete and provide all required information. Nominations must be submitted by 11:59 p.m. Eastern Time on April 12, 2010.
Nomination forms must be submitted online via the www.mikeandike.ca website. Once you have submitted your nomination, you will receive a confirmation email. Entries that are faxed or mailed will not be accepted.
HOW THE WINNERS ARE CHOSEN: The Sponsor's judging panel will select the Top 10 Nominations from all eligible nominations submitted. Nominations will be judged on originality, innovation, creativity, leadership, ability to inspire others, and the impact of nominees’ actions. The judging panel may contact nominees (or, where applicable, their parent/legal guardian) for information supporting their nomination.
The Top 10 nominees (or, for nominees who are under the age of majority, their parent/legal guardian) as determined by the judging panel will be contacted via email or phone on behalf of the Sponsor to confirm in writing their consent to participate in the Competition in accordance with these rules and regulations. In the event that such a nominee (or his/her parent/legal guardian) does not provide the required written consent or does not respond within 2 calendar days of being contacted on behalf of the Sponsor, his/her nomination will be withdrawn and the judging panel will select the next top nominee, who will be contacted as outlined above.
Once the top 10 nominees have been determined, between April 12 and April 26, 2010 they will be featured on www.mikeandike.ca where the public will then vote for their favourite, most deserving leader. The public will be asked to cast their vote based on originality, innovation, creativity, leadership, ability to inspire others, and the impact of their actions. Voting will close on May 25, 2010 at 11:59 p.m. Eastern Time. Note: there is a limit of one vote per person, per day during the voting period. For each of the three finalists with the most votes, a donation will be made to their registered charity of choice (see “Awards” below). Their work will also be featured in a promotional campaign and on the Canadian MIKE AND IKE® website. In the event of a tie, the applicable award(s) will be shared equally between the registered charities of choice of the applicable finalists.
ENTRY LIMIT: There is no limit to the number of people you would like to nominate, however a person can only be nominated once.
NO PURCHASE NECESSARY. There is no required purchase to make a nomination to the MIKE AND IKE® Ante Up! Competition. Simply visit www.mikeandike.ca and submit your nomination form.
AWARDS:
1st Place Donation (worth $2,500): A donation of $1,500 will be made to the top nominee’s registered charity of choice, along with $1,000 worth of MIKE AND IKE® candy (at retail value) for fundraising purposes.
2nd Place Donation (worth $1,500): A donation of $1,000 will be made to the second top nominee’s registered charity of choice, along with $500 worth of MIKE AND IKE® candy (at retail value) for fundraising purposes.
3rd Place Donation (worth $500): For the third top nominee, a donation of $500 worth of MIKE AND IKE® candy (at retail value) will be made to the third top nominee’s registered charity of choice to be used for fundraising purposes.
The Sponsor will confirm the registered status of the applicable charities and coordinate directly with such charities in making the donations.
ELIGIBILITY FOR NOMINATION: Nominees must be between 12 and 25 years of age at the time the nomination is submitted and a resident of Canada (excluding the Province of Québec). Employees, representatives, and agents (and persons with whom they are domiciled) of Just Born, Inc., its advertising and promotional agencies and parties engaged in the development, production and distribution of Contest materials are not eligible for nomination. Persons who submit a nomination and the nominees will be subject to these Official Competition Rules and Regulations and all decisions of the judges, which shall be final and binding on all entrants in all matters relating to this Competition. If a potential winner is found to be ineligible, fails to return required consents within the required time period, declines to accept the award, or in the event that an award confirmation is returned as undeliverable, such nominee will be disqualified from the Competition and the award will be awarded to the nominee with the next highest number of votes (subject to his/her compliance with these Official Rules and Regulations). Potential winners MAY be required to furnish proof of identification. Before being declared a winner, eligible winners (or, where applicable, their parent/legal guardian) MAY be required to sign a Declaration of Eligibility, and Release of Liability and Publicity, releasing Sponsor, their advertising and promotional agencies, the Just Born Prize Suppliers, and all of their respective affiliates, directors, officers, owners, partners, employees, agents, representatives, successors and assigns (collectively, the “Releasees”) from any liability or claims in connection with the Competition. Declaration and Release documents must be returned within 14 business days of notification, or the nomination will be withdrawn and the award will be awarded to the nominee with the next highest number of votes (subject to his/her compliance with these Official Rules and Regulations).
PAYMENT OF AWARDS: On or about May 31, 2010 the Top 3 nominees will be notified via email or phone and asked to confirm their registered charity of choice. The Sponsor will be verifying that the said charity has a valid registration number from the Government of Canada, and some delays in awarding the donation may arise due to this process. Where applicable, the Sponsor will make payment of the award amount directly to the nominee’s registered charity of choice. With respect to the MIKE AND IKE® candy, the Sponsor will arrange for its delivery directly to the nominee’s registered charity of choice, for the charity to use for fundraising purposes. Awards are not transferable or convertible to cash and must be accepted as awarded, with no substitutions of any kind, except by the Sponsor, who reserves the right to substitute an award of equal or greater value.
CONDITIONS OF NOMINATION: Persons submitting nominations represent and warrant that they have obtained the full and informed consent of the nominees (or, where applicable, their parent/legal guardian) with respect to the use of their personal information for the Competition in accordance with these Official Rules and Regulations. Nominees who have not provided such consent or who otherwise do not comply with these Official Rules are subject to disqualification.
- To be eligible, nominees (or, where applicable, their parent/legal guardian) must consent to the publication, reproduction and/or other use of his/her first name and address (city only), and a description of their charity/community/cause-related work (including naming the charity and city) without further compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, including print, broadcast or the Internet. The Top 10 nominees (or their parent/legal guardian where applicable) as determined by the judging panel will be required to provide such consent in writing and in the event that such consent is not provided within 2 calendar days of being contacted on behalf of the Sponsor, his/her nomination will be withdrawn and the judging panel will select the next top nominee, who will be contacted as outlined above.
- Sponsor and Releases are not responsible for late, lost, damaged, misdirected, illegible or incomplete nomination entries. Proof of transmission does not constitute proof of delivery. The decisions of the judging panel with respect to all aspects of this Competition are final and binding on all entrants without right of appeal.
- Nomination entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. Similarly, votes generated by script, macro, robotic, programmed, or any other automated means are prohibited and will not be included in determining the winning nominees.
- To be eligible nominees must assume in writing liability for injuries caused, or claimed to be caused by participating in the Competition, including the awarding of any award.
- Any nomination entry mechanism, or any other materials used in this Competition that have been tampered with, altered, reproduced, not legitimately obtained, or which contain or reflect any error will be void. Without limiting the release of liability provisions herein, and for greater certainty, the Sponsor and Releasees will not be liable for: a) any incorrect or inaccurate information, whether caused by Competition website users or by any equipment or programming associated with or utilized in the Competition or by any technical or human error which may occur in the processing of nomination entries in the Competition; b) any error, omission, interruption, deletion, defect or delay in operation of the Competition website or any transmission in connection with the Competition; c) any communications line failure, theft, destruction or unauthorized access to, or alteration of, entries; d) any problems with, or technical malfunction of, any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, or failure of e-mail which may occur for any reason whatsoever, including technical problems or traffic congestion on the Internet or at any website or combination thereof; or e) any injury or damage to entrants' or to any other person's computer related to or resulting from participating or downloading materials in this Competition. If the Competition is not capable of running as planned for any reason, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause of any nature whatsoever, Sponsor reserves the right in their sole discretion to, without advance notice, terminate or suspend the Competition, or modify these Rules, in whole or in part, in any way, at any time.
- All entries become the property of the Sponsor.
- Sponsor reserves the right in its sole discretion to disqualify any individual from the Competition, and to ban that individual from any future promotion of Sponsor, if Sponsor finds or believes such individual to be tampering with the entry process or the operation of the Competition or where applicable, the Competition website; to be acting in violation of the Official Rules or in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass Sponsor, Sponsor agencies, other entrants or any other person. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE COMPETITION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR AND RELEASEES RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
